font-family: Arial;" class="MsoNormal"><span style="font-size: 10pt;"><o>&nbsp;</o></span></p><p style="text-align: justify; font-family: Arial;" class="MsoNormal"><span style="font-size: 10pt;">Người đượcxác định bị phơi nhiễm với HIV do tai nạn rủi ro nghề nghiệp khi có đủ các điềukiện: Khi đang thi hành nhiệm vụ</span><span style="font-size: 10pt;"> bị 1 trong 3 tai nạn (bị kim, vật nhọn đâm, vậtsắc cứa xuyên qua da hoặc vật làm da bị trầy xước, nứt nẻ mà những vật này đãtiếp xúc với máu, sản phẩm máu hoặc dịch cơ thể người nghi nhiễm HIV; bị máu, sảnphẩm máu, dịch cơ thể người nghi nhiễm HIV tiếp xúc trực tiếp với da bị trầy xước,nứt nẻ hoặc tiếp xúc trực tiếp với niêm mạc mắt, mũi, miệng); có Biên bản tai nạnrủi ro nghề nghiệp và được lập trong vòng 48 giờ kể từ khi xảy ra tai nạn, cóxác nhận của người làm chứng và được thủ trưởng cơ quan quản lý trực tiếp ngườibị phơi nhiễm với HIV ký, xác nhận; kết quả xét nghiệm HIV bằng kỹ thuật ELISAcủa người bị phơi nhiễm với HIV là âm tính.<o></o></span></p><p style="text-align: justify; font-family: Arial;" class="MsoNormal"><span style="font-size: 10pt;"><o>&nbsp;</o></span></p><p style="text-align: justify; font-family: Arial;" class="MsoNormal"><span style="font-size: 10pt;">Điều kiệnxác định người bị nhiễm HIV do tai nạn rủi ro nghề nghiệp gồm: Có Giấy chứng nhậnbị phơi nhiễm với HIV của cơ quan có thẩm quyền và kết quả xét nghiệm HIV củangười bị phơi nhiễm với HIV tại 1 trong 3 thời điểm: 1 tháng, 3 tháng và 6tháng sau khi bị tai nạn rủi ro nghề nghiệp là dương tính do cơ sở y tế có thẩmquyền cấp.<o></o></span></p><p style="text-align: justify; font-family: Arial;" class="MsoNormal"><span style="font-size: 10pt;"><o>&nbsp;</o></span></p><p style="text-align: justify; font-family: Arial;" class="MsoNormal"><span style="font-size: 10pt;">Các cơquan tiếp nhận hồ sơ và có thẩm quyền cấp Giấy chứng nhận bị phơi nhiễm với HIVdo tai nạn rủi ro nghề nghiệp và Giấy chứng nhận bị nhiễm HIV do tai nạn rủi ronghề nghiệp, gồm: Cục Quân y thuộc Bộ Quốc phòng; Cục Y tế Bộ Công an; CụcPhòng, chống tệ nạn xã hội thuộc Bộ Lao động, Thương binh và Xã hội; Sở Y tếthuộc Bộ Giao thông vận tải; Cục Phòng, chống HIV/AIDS thuộc Bộ Y tế và Sở Y tếtỉnh, thành phố trực thuộc Trung ương.<o></o></span></p><p style="text-align: justify;
