Nguyên tắc thông báo kết quả xét nghiệm HIV dương tính:<o

Chỉ được thông báo kết quả xét nghiệm HIV dương tính khi kết quả này được khẳng định bởi phòng xét nghiệm được Bộ Y tế công nhận đủ điều kiện khẳng định các trường hợp HIV dương tính </span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="NL">theo Quyết định số 3052/2000/QĐ-BYT ngày 29/8/2000 của Bộ trưởng Bộ Y tế về việc ban hành “Tiêu chuẩn phòng xét nghiệm được phép khẳng định các trường hợp HIV dương tính”</span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">;<span style=""><o

Chỉ được thông báo kết quả xét nghiệm HIV dương tính đến những đối tượng được quy định tại khoản 1 Điều 30 của Luật phòng, chống nhiễm vi rút gây ra hội chứng suy giảm miễn dịch mắc phải ở người (HIV/AIDS);</span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="NL"><o

Phải tư vấn trước khi thông báo kết quả xét nghiệm cho tất cả những người được xét nghiệm HIV theo đúng nội dung tư vấn do Bộ trưởng Bộ Y tế quy định</span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="FR">;<o

Chỉ những người thuộc đối tượng quy định tại Mục II của Thông tư này mới được thực hiện việc thông báo kết quả xét nghiệm HIV dương tính;<o

Việc vận chuyển, giao nhận kết quả xét nghiệm HIV dương tính phải thực hiện theo đúng quy định tại Mục IV của Thông tư này.<o

Việc tư vấn và trả kết quả xét nghiệm được thực hiện như sau:<o

Trường hợp người được xét nghiệm là người dưới 18 tuổi hoặc là người mất năng lực hành vi dân sự, không có năng lực hành vi dân sự hoặc có năng lực hành vi dân sự nhưng không đầy đủ: Người chịu trách nhiệm trả kết quả xét nghiệm HIV dương tính tiến hành việc tư vấn và </span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="NL">trả kết quả xét nghiệm cho cha hoặc mẹ hoặc người giám hộ của họ sau khi đã tư vấn cho những người này. Việc thông báo kết quả xét nghiệm cho </span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">các đối tượng này chỉ được thực hiện sau khi được sự đồng ý bằng văn bản của </span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="NL">cha hoặc mẹ hoặc người giám hộ của họ.</span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR"><o

Trường hợp người được xét nghiệm là người từ đủ 18 tuổi trở lên: Người chịu trách nhiệm trả kết quả xét nghiệm HIV dương tính tiến hành việc tư vấn và trả kết quả xét nghiệm sau khi đã tư vấn cho người được xét nghiệm HIV.<o

Thời gian thông báo kết quả xét nghiệm HIV dương tính: <o

></span></b></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">Việc thông báo kết quả xét nghiệm HIV dương tính phải được thực hiện chậm nhất là 72 giờ kể từ khi người chịu trách nhiệm thông báo kết quả xét nghiệm nơi người bệnh được lấy mẫu xét nghiệm nhận được phiếu trả lời kết quả xét nghiệm HIV dương tính, trừ các trường hợp sau đây:<o

Người đứng đầu cơ sở có phòng xét nghiệm được phép khẳng định các trường hợp HIV dương tính.<o

Người được ủy quyền bởi người đứng đầu các cơ quan, tổ chức sau đây:<o

Việc ủy quyền phải được thực hiện bằng văn bản. </span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="NL">Văn bản ủy quyền của người đứng đầu cơ quan, tổ chức nêu tại khoản 2, 3 Mục II của Thông tư này phải xác định rõ phạm vi, nội dung và thời hạn của việc ủy quyền thông báo kết quả xét nghiệm HIV dương tính đối với người được ủy quyền. <o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="NL">Người được ủy quyền của người đứng đầu cơ quan, tổ chức nêu tại khoản 2, 3 Mục II của Thông tư này phải chịu trách nhiệm về việc thông báo kết quả xét nghiệm HIV dương tính của mình trước người ủy quyền và trước pháp luật. Người được ủy quyền không được ủy quyền tiếp cho bất kỳ cá nhân nào khác.</span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR"><o

Các trường hợp khác chỉ được thông báo kết quả xét nghiệm HIV dương tính bằng miệng và không trả phiếu trả lời kết quả xét nghiệm HIV dương tính.<o

Bác sỹ trực tiếp điều trị cho người bệnh có trách nhiệm tư vấn và thông báo kết quả xét nghiệm cho người bệnh; <o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">Trường hợp người bệnh không thể tiếp nhận thông tin tư vấn, phải đề nghị vợ hoặc chồng </span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="NL">của người được xét nghiệm hoặc cha, mẹ hoặc người giám hộ của người được xét nghiệm là người chưa thành niên hoặc là người mất năng lực hành vi dân sự, không có năng lực hành vi dân sự hoặc có năng lực hành vi dân sự nhưng không đầy đủ đến bộ phận tư vấn </span><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">để tiến hành tư vấn và thông báo kết quả xét nghiệm cho họ;<o

Trường hợp người bệnh phải chuyển khoa, điều dưỡng viên trưởng khoa hoặc phòng nơi người bệnh chuyển đi phải chuyển phiếu trả lời kết quả cho điều dưỡng viên trưởng của khoa hoặc phòng nơi tiếp nhận người bệnh khi chuyển hồ sơ bệnh án; <o

Trường hợp người bệnh phải chuyển viện, phải chuyển phiếu trả lời kết quả xét nghiệm HIV dương tính kèm theo hồ sơ bệnh án;<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">Người chịu trách nhiệm tiếp nhận bệnh nhân của cơ sở khám bệnh, chữa bệnh nơi người bệnh được chuyển đến có trách nhiệm chuyển phiếu trả lời kết quả xét nghiệm HIV cùng hồ sơ bệnh án đến khoa, phòng nơi người bệnh sẽ điều trị. Điều dưỡng viên trưởng của khoa hoặc phòng nơi tiếp nhận người bệnh chỉ được báo cáo với trưởng khoa về tình trạng nhiễm HIV của người bệnh để trưởng khoa thông báo cho bác sỹ và điều dưỡng viên trực tiếp chăm sóc, điều trị cho người bệnh.<o

Trường hợp người bệnh ra viện, phiếu trả lời kết quả xét nghiệm HIV được cùng hồ sơ bệnh án theo quy định của pháp luật về lưu trữ.<o

Người phụ trách bộ phận hoặc phòng y tế có trách nhiệm:<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">c) Tiến hành việc tư vấn (nếu đã có chứng nhận đã qua tập huấn tư vấn về phòng, chống HIV/AIDS) hoặc chuyển người được xét nghiệm đến cơ sở đủ điều kiện tư vấn về phòng, chống HIV/AIDS để tiến hành tư vấn hoặc mời nh ân viên tư vấn của cơ sở đủ điều kiện tư vấn về phòng, chống HIV/AIDS đến để tiến hành tư vấn;<o

Trường hợp người được xét nghiệm chuyển đến cơ sở khác: Người đứng đầu cơ sở nơi người được xét nghiệm chuyển đi có trách nhiệm chuyển phiếu trả lời kết quả xét nghiệm HIV kèm theo hồ sơ của người đó đến cơ sở nơi người được xét nghiệm được chuyển đến;<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">5.4. Trường hợp người được xét nghiệm được gia đình hoặc tổ chức, cá nhân khác nhận nuôi dưỡng (sau đây gọi chung là người nhận nuôi dưỡng), thực hiện việc tư vấn và thông báo kết quả xét nghiệm theo quy định tại khoản 3 Mục I của Thông tư này. Trường hợp người nhận nuôi dưỡng là tổ chức thì kết quả xét nghiệm chỉ được thông báo cho người trực tiếp chăm sóc, nuôi dưỡng.<o

Đối với việc vận chuyển kết quả xét nghiệm HIV dương tính từ cơ sở này sang cơ sở khác: </span></b><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">Phiếu trả lời kết quả xét nghiệm HIV dương tính phải được cho vào phong bì dán kín, ghi rõ họ, tên, địa chỉ của người nhận và đóng dấu nhiêm phong của cơ sở nơi gửi kết quả xét nghiệm HIV dương tính, trừ trường hợp kết quả xét nghiệm được chuyển cùng hồ sơ bệnh án hoặc hồ sơ sức khỏe của người được xét nghiệm.<o

Quy định về vận chuyển, giao nhận kết quả xét nghiệm tại các cơ sở không đủ điều kiện khẳng định các trường hợp HIV dương tính:<o

Sau khi lấy máu, cơ sở nơi lấy máu phải lập danh sách dưới dạng mã hóa các thông tin của người được xét nghiệm và gửi đến cơ sở xét nghiệm đủ điều kiện khẳng định các trường hợp HIV dương tính;<o

Cơ sở xét nghiệm đủ điều kiện khẳng định các trường hợp HIV dương tính thực hiện việc xét nghiệm và trả lời kết quả theo danh sách do cơ sở lấy mẫu máu gửi;<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">3.3. Trên cơ sở danh sách do cơ sở xét nghiệm đủ điều kiện khẳng định các trường hợp HIV dương tính trả lời, cơ sở lấy mẫu máu tách thành từng phiếu trả lời kết quả để trả cho người được xét nghiệm. Việc thông báo kết quả xét nghiệm được thực hiện theo quy định tại Mục III của Thông tư này.<o

Người đứng đầu các cơ quan, tổ chức nơi có thực hiện việc thông báo kết quả xét nghiệm HIV dương tính có trách nhiệm:<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">b) Phân công nhân viên tư vấn và phổ biến các quy định của Thông tư này đến toàn thể các nhân viên thuộc quyền quản lý.<o

Sở Y tế tỉnh, thành phố trực thuộc trung ương có trách nhiệm:<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">b) Kiểm tra, giám sát việc thực hiện các quy định của Thông này trên địa bàn được giao quản lý.<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">3. Cục Phòng, chống HIV/AIDS có trách nhiệm:<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">a) Xây dựng tài liệu tập huấn tư vấn về phòng, chống HIV/AIDS trình lãnh đạo Bộ hê duyệt và tổ chức triển khai sau khi được phê duyệt;<o

></span></p> <p style="margin: 0in 0in 6pt; text-align: justify; line-height: 110%; text-indent: 0.5in;" class="MsoNormal"><span style="line-height: 110%; font-family: 'Arial','sans-serif'; color: windowtext; font-size: 10pt;" lang="PT-BR">b) Chủ trì, phối hợp với Cục Quản lý khám, chữa bệnh và các đơn vị có liên quan xây dựng hướng dẫn bố trí bộ phận tư vấn về HIV/AIDS tại các cơ sở y tế; <o
